Welcome to TANHA SongWorks. By accessing or using our website, purchasing our services, or interacting with any content created by us, you agree to be bound by these Terms & Conditions. Please read them carefully before proceeding.

1. Definitions

“We”, “Us”, “Our” refer to TANHA SongWorks. “You”, “Customer / Client” refer to the person purchasing or using our services. “A Gentle Beginning” refers to a custom-created audio track for personal use or gifting. “A Deeper Story” refers to a personalised song experience created with extended narrative depth and structure. “Legacy & Brand Anthem” refers to music created for business, branding, or commercial use. “Project” means the complete creative and delivery process of the ordered song.

2. Acceptance of Terms

By placing an order or clicking the confirmation/checkout button, you confirm that you have read, understood, and agreed to these Terms & Conditions, including the experience-specific usage rights applicable to your purchase. You further agree that you will not use the delivered song in any manner that violates these Terms, applicable law, or third-party rights.

3. Services Offered

  • Personalised songs for gifting and celebrations
  • Premium-quality personalised songs with advanced production of longer duration
  • Corporate jingles, branding music, and startup theme tracks
  • Poetry-to-song and story-to-song conversions
  • Songs for events, social media (where permitted by package), campaigns, and surprises

4. Payment Terms

  • Full payment is required before the project begins.
  • Payments are accepted via Razorpay and other approved methods.
  • Pricing may change in the future, but confirmed orders remain unaffected.
  • Work starts only after you submit all required details and the payment clears.

5. No Refund Policy

  • All songs are custom-created; refunds are not possible once the creation process begins.

6. Delivery Policy

  • Delivery timelines begin after all required information is submitted and payment is received.

7. Revisions Policy

  • A Gentle Beginning: 1 complimentary revision; additional revisions ₹499 each
  • A Deeper Story: 2 complimentary revisions; additional revisions ₹399 each
  • Legacy & Brand Anthem: 2 complimentary revisions; further revisions quoted separately
  • Revisions cover reasonable changes to vocals, lyrics, mixing, or arrangement. Major reworks may incur extra charges.

8. Song Experiences & Usage Rights

TANHA SongWorks offers personalised songs under the following Song Experiences:

A Gentle Beginning

  • This Song Experience is intended for personal listening and gifting. You may share the song on non-monetised social-media platforms (such as Instagram, Facebook, WhatsApp, or YouTube) with visible credit to TANHA SongWorks and a link to tanhasongworks.com. Commercial use, monetisation, or paid promotion is not permitted.

A Deeper Story

  • This Song Experience includes permission to share the song on non-monetised social-media platforms, provided clear credit to TANHA SongWorks with a link to tanhasongworks.com is given. The song may not be used for commercial purposes, paid promotions, advertisements, or monetised channels unless explicitly agreed in writing.

Legacy & Brand Anthem

  • This Song Experience includes commercial-use rights as agreed at the time of purchase. Songs created under this experience may be used for branding, marketing, promotional, and commercial purposes, subject to the agreed scope.
  • Use across television, radio, OTT platforms, or large-scale public distribution may require additional licensing and fees, depending on the scope and nature of usage.

Intellectual Property: TANHA SongWorks retains ownership of the compositions, melodies, lyrics, performances, and arrangements. Customers receive only the usage rights expressly granted by their purchased package. Ownership transfer is not included unless explicitly agreed in writing.

9. Prohibited Uses & Consequences of Breach

  • You must not use the song for illegal, defamatory, hateful, or obscene content. You must not infringe any third-party rights when using the song.
  • If the song is used in breach of these Terms (including uploading where not permitted or monetising without a commercial license), TANHA SongWorks may, at its discretion, revoke the licence, request takedown, seek injunctive relief, and pursue damages or any other legal remedy available under applicable law.
  • You agree to promptly comply with any takedown or remedial request from TANHA SongWorks or its licensors.

10. Indemnity & Liability

You agree to indemnify, defend and hold harmless TANHA SongWorks, its owners, employees, agents, and contractors from and against any claims, liabilities, damages, losses, costs, and expenses (including legal fees) arising out of or in any way connected with your use of the song, your breach of these Terms, or your violation of any third-party rights.

Disclaimer of Liability: To the fullest extent permitted by law, TANHA SongWorks disclaims all liability for any indirect, incidental, special, or consequential damages arising from the use or inability to use the songs. In particular, if a customer uses any song for unlawful, defamatory, hateful or harmful purposes, TANHA SongWorks disclaims liability for such misuse — liability for such acts will rest solely with the customer. This disclaimer does not exclude or limit liability for gross negligence or willful misconduct to the extent not permitted by applicable law.

11. Confidentiality

We will treat your stories, personal details, and creative briefs as confidential and will not publish or use them publicly without your permission. If you want a song or brief to be public, please provide explicit written consent.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Lucknow, India. Prior to commencing court proceedings, the parties will attempt to resolve the dispute amicably, and may choose mediation or arbitration by mutual written agreement.

13. Privacy & Data

We collect and use personal information (name, contact, story details) only to create and deliver your song and to process payments. Our Privacy Policy (linked on the site) explains how we collect, use, and protect your data. By ordering, you consent to such processing. If you wish to request deletion of your data, contact support@tanhasongworks.com.

14. Acceptance Mechanism

You accept these Terms by (a) checking the “I agree” checkbox presented at checkout or on the package page and (b) completing the payment. This “clickwrap” acceptance is a binding agreement between you and TANHA SongWorks.

15. Usage Rights & License by Song Experience

  • A short Package-wise License Agreement (summary of rights specific to your purchased package) will be emailed to you upon order confirmation.
  • Standard deliverables include MP3 (320 kbps). WAV or other formats are available as add-ons if selected.
  • We will not routinely send separate signed PDF licenses unless specifically requested or required by the client; the emailed package-license and these Terms constitute the license granted.

16. Changes to Terms

We may update these Terms from time to time. Updates will be posted on this page with a revised effective date. Orders made prior to a change remain governed by the Terms in effect at the time of order.
